Policy Statement - CPRA CCPA

NGi takes your privacy seriously. The company will not sell, share, disclose, or exploit your data or use your personal information for our commercial purposes, or purposes which violate the Consumer Privacy Act (CCPA) and subsequent California Privacy Rights Act (CPRA). Team members will be informed about the categories of personal information collected and the purpose before the time of collection.

 

This privacy policy applies to all information collected by NGi for the purposes of conducting business, including personnel file construction and maintenance, payroll, and other business functions. The rights and obligations described in this policy will apply to all NGi Team members.

 

NGi recognizes the confidential nature of the personal information in its care and is accountable for the compliance and security of this information of Team members.

Definition

This policy protects information collected in any form, including oral, electronic, or written. Personal information includes but is not limited to name, home address, home phone number, home email address, identity verification information, Social Security Number, age, gender, medical and health information (when appropriate for detecting and containing health and safety risks), education, professional achievements, employment history, credit history, bank information, performance reviews, veteran status, contents of resume, refences, interview notes, and emergency contact information.

Personal information will not include business title, business contact information, or length of service/tenure when used or disclosed for the purposes of reasonable business communication.

Collection of information

Personal information will be collected, used and disclosed for purpose pertaining to the Employee’s relationship with NGi. The type and amount of personal information collected by NGi will be limited to the minimum necessary to accomplish reasonable business objectives, including but not limited to the administration of employee hiring; performance reviews; the administration of employee payroll; processing of employee benefits and benefit claims; complying with all applicable and employment legislation; detecting and containing health and safety risks, and other disclosures which may be required by law.

NGi may use personal information for a purpose other than originally stated, where the new purpose is required by law or where NGi has obtained consent in writing from the affected individual for each new purpose.

 

NGi will not sell or share information with any unauthorized parties.

Consent and Employee Opt-Out

Team members shall have the right to request that the company delete any personal information about the employee which the business has collected from the employee. Knowledge and consent are required from the affected Employee for the collection, use and discloser of all personal information subject to exceptions noted elsewhere in this policy. Consent will not be obtained through deception or misrepresentation. Any use or disclosure of personal information will be with the reasonable expectations of the Employee.

Subject to legal and contractual obligations, an Employee may withdraw their consent and opt of out disclosure of personal information.

Confidentiality and Security

NGi will at all times respect the confidentiality of the personal information placed in is care. NGi will endeavor to ensure that the policies affecting the collection, storage and discloser of personal information support NGi’s commitment to Employee privacy.

NGi will comply with all applicable privacy legislation and regulations protecting the confidentiality of personal information.

Access to Information 

All personal information will be released internally only on a need-to-know basis. In the course of normal and reasonable business practices it is the policy of NGi to grant designated representatives’ access to personal information files. This access will not exceed that necessary to accomplish the specific business function of NGi Representative nor the purpose for which the information was originally collected.

Access to Information 

NGi is subject to the privacy legislation in all jurisdictions in which NGi operates. If any term, covenant, condition or provision of this Privacy Policy is held by a court of competent jurisdiction to be invalid, void or unenforceable, it is the intent of this Privacy Policy that the scope of the rights and obligations of the Privacy Policy be reduced only for the affected jurisdiction and only to the extent deemed necessary under the laws of the local jurisdiction to render he provision reasonable and enforceable. The remainder of the provisions of the Privacy Policy statement will in no way be affected, impaired or invalidated as a result. 

Where this Privacy Policy provides greater rights and protections to the Individual than the available governing law, the terms of this Privacy Policy will prevail wherever allowed by law.
